CONDITIONS OF SALE

la) The “Company” refers to Maple Leaf Design Supplies. The “Purchaser” means the person or person’s firm or company, purchasing from the Company.

b) The “Goods” means products, or services, supplied by the Company.

 

2a) These Conditions of Sale should be read in conjunction with any Special Conditions included in the Company’s quotations to the Purchaser.

b) The Company reserves the right to accept or refuse any order given on the basis of its quotations and in the event of the refusal of any order, no damages or expenses shall be payable by the Company.

c) Any complaint about the goods supplied must be made in writing within 7 days of delivery quoting advice note number.

d) The decision of the Company about any alleged defect shall be final and conclusive.

e) No claim can be allowed when goods supplied have been cut, printed, or processed by the buyer.

f) Goods returned may incur a handling charge. The Company reserves the right of discretion to decide whether goods returned are entitled to credit. Specially produced or converted goods are not returnable.

g) Dimensions, weights, colour and descriptions of the goods stated on an offer acceptance, catalogue, circular or price list are approximate only and not binding to exact details.

h) Quotations and offers are given, and contracts of sale are only accepted, subject to these conditions. Any variation of such by the Purchaser will be treated as inapplicable and of no effect unless specifically agreed in writing by the Company.

i) Unless otherwise stated VAT is charged at standard rate prevailing.

 

3a) Printed price lists or offer sheets are subject to alteration without notice by the Company.

b) Orders are accepted at the prices ruling on the date of delivery by the Company.

 

4a) Title to all goods supplied shall remain with the company until paid for in full by the Purchaser, although risk passes to the Purchaser on delivery.

b) If payment is delayed beyond the agreed terms, the Company reserves the right to charge interest on the balance at a rate of 4% p.a. above NatWest base rate.

 

5) The Company shall not be responsible for any delay in delivery owing to matters outside the Company’s control.

 

6a) The Company shall not be liable for any consequential loss of any description incurred by the Purchaser as a result of any failure or fault in the Goods or for any damages, personal injuries, machine downtime or other losses whether caused directly or indirectly by the Goods.

b) The Company shall pass on to the Purchaser the benefit of any Guarantees or Warranties provided by the manufacturers of the goods, but without prejudice to clause 6a) above.
